When you read the background on this story it is obvious that these two cops slept through their Situational Awareness training at the academy otherwise they might have noticed they parked on a friggin railroad track.
This reminded of the article The Return of the Gunslinger where a Federal Judge stated in no uncertain terms that Law Enforcement has no Constitutional Basis to Protect citizens except those who are “in Custody.”
“Neither the Constitution, nor state law, impose a general duty upon police officers or other governmental officials to protect individual persons from harm — even when they know the harm will occur,” said Darren L. Hutchinson, a professor and associate dean at the University of Florida School of Law. “Police can watch someone attack you, refuse to intervene and not violate the Constitution. The Supreme Court has repeatedly held that the government has only a duty to protect persons who are “in custody.”
So just to be clear: You, the taxpaying citizen can only expect Cops to protect you when they arrest you.
