In Yesterdays article titled Self-Defense Cautionary Tales: Is a $16 Hatchet Worth It?
I stated that the thief was not ARMED at the time of the shooting.
“It would have been different if the guy had the hatchet it in his hand and was threatening the guy, but that was not the case.”
Well, as a good friend pointed out to me, YES, in fact the thief WAS ARMED with said axe at the time of the shooting, (You can see the axe in his right hand when he is going out the door.)
This changes the entire incident folks, at least according to self-defense law.
Marry this with the store owner feeling “in fear for his life” and it is an open and shut case.
Entering into the argument of “Well the thief was not swinging the axe or acting threatening with it” is asinine.
We cannot determine INTENT from a 50 second video clip!
It’s a shame anytime a person has to kill another person to protect themselves, but we have to understand that the store owner had a split second to make a decision we have a lifetime to analyze.
“Better to be judged by 12 than carried by 6”
