The lib-tards tactics are nothing new: Since they cannot stop guns from being carried on TX Campuses, they are ATTEMPTING to make the carrying of a gun as USELESS as possible by enacting ridiculous &#8220;safety&#8221; measures such as (1) Not allowing any gun carried on campus to be carried with a round in the chamber and (2) creating &#8220;GUN FREE ZONES&#8221; within the campus, and not allowing guns to be carried OR stored in college dorms. The first measure was so ludicrous it was shot down immediately, the second, as the article re-iterates, clearly violates S.B.-11. -SF<\/strong><\/em><\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-10230\" src=\"https:\/\/hcsblogdotorg.files.wordpress.com\/2015\/12\/ag.jpg?w=620\" alt=\"AG\" width=\"620\" height=\"465\" \/><\/p>\n<p>Texas public universities cannot ban guns in dormitories\u00a0because it violates Senate Bill 11, said Texas Attorney General Ken Paxton in a <a href=\"https:\/\/www.texasattorneygeneral.gov\/opinions\/opinions\/51paxton\/op\/2015\/kp0051.pdf?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=\" target=\"_blank\" rel=\"noopener\">nonbinding opinion<\/a>\u00a0Monday about the new state law known as \u201ccampus carry.\u201d This came in response to a request (<a href=\"https:\/\/www.texasattorneygeneral.gov\/opinions\/opinions\/51paxton\/rq\/2015\/pdf\/RQ0076KP.pdf?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=\" target=\"_blank\" rel=\"noopener\">RQ-0076-KP<\/a>) filed by state Sen. Brian Birdwell (R-Granbury), the bill\u2019s author.<\/p>\n<p>In his request, Birdwell clarified the term \u201ccampus carry\u201d as a misnomer since \u201cit has been legal for Texas concealed handgun licensees to carry on college campuses since 1996,\u201d noting that\u00a0S.B. 11 decriminalizes \u201cthe carrying of concealed handguns in College buildings, activity grounds and transportation vehicles\u2026It also prohibits public colleges from adopting \u2018any rule, regulation, or other provision prohibiting\u00a0license holders from carrying handguns on the campus of the institution.&#8217;\u201d It defines \u201ccampus\u201d as \u201call land and buildings owned or lease.\u201d<\/p>\n<p>S.B. 11 goes into effect at Texas public colleges and universities on August 1, 2016 and at community colleges one year later. Private colleges, however, can opt out. Public higher education institutions can designate some parts of their campuses as \u201cgun free zones,\u201d including some buildings, although the\u00a0law states that those gun-free zones cannot make it impossible to reasonably carry a handgun at all, which pertains to dormitories.\u00a0Paxton wrote: \u201cIf an institution placed a prohibition on handguns in the institution\u2019s residential facilities, however, it would effectively prohibit license holders in those facilities from carrying concealed handguns on campus, in violation of S.B. 11.\u201d<\/p>\n<p>The Attorney General also stated\u00a0S.B. 11 permits universities to create \u201crules, regulations, or other provisions concerning the storage of handguns in dormitories\u2019 which he noted \u201cpresupposed their presence in dormitories.\u201d The University of Texas at Austin\u00a0created a campus carry task force which recommended allowing concealed handguns inside classrooms but banning them in dormitories and at sporting events,\u00a0Dallas\u2019 WFAA 8 (ABC) <a href=\"http:\/\/www.wfaa.com\/story\/news\/local\/texas-news\/2015\/12\/21\/paxton-universities-cant-ban-guns-dorms\/77731286\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>. The task force\u2019s concerns centered on potential improper storage of firearms in the dormitory, allowing access to someone other than the owner.\u00a0In his\u00a0opinion, Paxton evaluates what is in the law but does not address\u00a0safety issues.<\/p>\n<p>UT-Austin\u00a0emerged as a fierce critic of S.B. 11. Professor Joan Neuberger organized the anti-campus carry group Gun Free UT. Breitbart Texas <a href=\"http:\/\/www.breitbart.com\/big-government\/2015\/10\/02\/163-ut-professors-say-no-guns-classrooms-2nd-amendment-backers-arrested\/\">reported<\/a>\u00a0on her opposition to\u00a0all guns on campus. She claimed\u00a0if the university did not repeal \u201ccampus carry,\u201d Gun Free UT might sue. Neuberger and other professors protested, asserting\u00a01,000 UT faculty members opposed guns in their classrooms. Education lobbyists also <a href=\"http:\/\/www.breitbart.com\/big-government\/2015\/11\/13\/national-education-lobbyists-gang-crush-texas-campus-carry\/\">stood<\/a>\u00a0against S.B. 11,\u00a0as did UT System Chancellor William McRaven, former head of U.S. Special Operations Command who directed the raid that killed Osama Bin Laden,\u00a0<a href=\"http:\/\/kxan.com\/2015\/12\/22\/texas-ag-says-banning-guns-in-college-dorms-violates-new-law\/\" target=\"_blank\" rel=\"noopener\">according to<\/a> Austin NBC affiliate KXAN 36.<\/p>\n<p>However,\u00a0\u201ca court would likely conclude that a public institution of higher education exceeds the authority granted under Senate Bill 11 if it prohibits the carrying of concealed handguns in a number of classrooms or delegates to individual professors the decision as to whether possession of a concealed handgun is allowed in the individual professor\u2019s classroom,\u201d the opinion\u00a0read.<\/p>\n<p>KXAN 36 cited approximately 48,000 students on the UT-Austin campus of which only 2.5 percent are over 21 years old and live in the dorms. The task force found almost\u00a099 percent of that student population\u00a0live off of the Austin campus, according to the Dallas ABC affiliate. Quick facts about S.B. 11 <a href=\"https:\/\/www.tamuk.edu\/campuscarrylaw\/index.html\" target=\"_blank\" rel=\"noopener\">posted<\/a> online by Texas A&amp;M at Kingston said Texans must be 21-years-old to obtain a concealed carry license and pass the background check plus the\u00a0concealed handgun license (CHL) class, written, and\u00a0proficiency exams conducted by instructors certified by the Texas Department of Public Safety (DPS). In 2014, Texans aged 21-30 comprised 1.44 percent of CHL holders. The\u00a0campus estimated 400 students in residence halls are over 21-years-old.
